Picuco is a digital platform for discovering activities, experiences, and getaways in rural and natural environments. We help users explore and contact independent providers (the "Providers"). Picuco does not organize or operate the listed activities directly, nor does it provide tourism services in its own name.

2. Our Services

Picuco's services (the "Services") include:

• The Website and its subdomains.
• Mobile Applications (if any).
• The interfaces and communication tools to connect Users with Providers.

3. Users

The following are considered Users:

• People who browse, search, or consult activities.
• People who request information or contact with Providers.
• Providers who publish or wish to publish their activities (also referred to as "Providers" when applicable).

Minimum age:

You must be 18 years old or use the platform with authorization from a parent/guardian. Use by minors under 16 years is not permitted.

4. Application of these Terms

These Terms are binding for any use of the Services. We may update the Terms at any time. The current version will be the one published on the Site with the update date. Continued use implies your acceptance.

5. Your use of the Services

Picuco grants you a personal, non-exclusive, non-transferable, and revocable right to access and use the Services for the purposes of:

• Exploring content and experiences.
• Sending information requests or contact requests to Providers.

The following, among others, is prohibited:

• Copying, modifying, decompiling, or creating derivative works of the Site/Apps.
• Using the Services for illegal, fraudulent purposes, or to harm third parties.
• Extracting data on a large scale (scraping) or circumventing technical security measures.
• Impersonating third parties or publishing illegal or infringing content.

6. Picuco's role

• Picuco is not a party to the contract between User and Provider.
• Providers are solely responsible for the information about their activities, their legality, licenses, insurance, safety, and the proper execution of the contracted service.
• Picuco may transmit requests and facilitate contact, as well as perform editorial curation and recommendations.
• Where applicable, Picuco may display indicative rates; the final price will be communicated or confirmed by the Provider.

7. Fees and revenue model

Picuco may generate revenue through:

1. Provider commissions for bookings closed with customers referred by Picuco.
2. Booking fee shown to the User, when applicable, before confirming the request (if enabled).
3. Picuco Pro subscription for Providers (visibility, management, or tool services).

8. Registration and accounts

Currently registration is not required for Users. If registration or personal spaces are enabled in the future, we will update these Terms and the privacy documentation.

9. Content and rights

9.1 Site Content

The texts, images, designs, brand, logos, software, and other elements of the Site are the property of Picuco or third-party licensors and are protected by intellectual property. Their reproduction, distribution, or unauthorized use is not permitted.

9.2 User Content (including chat)

If you publish, send, or share content (for example, in the chat):

• You grant us a non-exclusive, free, worldwide license to host, reproduce, and display that content only to provide and improve the Services.
• You must guarantee that you have the rights to share it and that it does not infringe third-party rights or the law.
• Do not publish sensitive data or private information that you do not wish to share.
• We may moderate or remove content that violates these Terms.

10. Conduct and prohibited uses

The following is prohibited:

• Publishing illegal, defamatory, misleading, discriminatory, violent, explicit sexual content, or content that violates rights.
• Sharing third-party personal data without legal basis.
• Introducing malware, carrying out attacks, or interfering with the Site's operation.
• Using the Services to capture data or divert traffic to competing services.

Picuco may suspend access to anyone who violates these rules.

11. Additional services; coupons and vouchers

In the future, Picuco may offer promotions, coupons, or vouchers. Each promotion will be governed by specific terms that will be communicated at the time of launch. Picuco may modify or cancel them when reasonable.

12. External links

The Site may contain links to third-party websites. Picuco does not control these sites nor is responsible for their content or policies. Their use is governed by the terms and privacy of such third parties.

13. Warranty disclaimer

The Site and Services are provided "as is" and "as available". Picuco does not guarantee that the service will be uninterrupted or error-free, nor the accuracy, availability, or suitability of third-party activities. To the extent permitted by law, implied warranties of merchantability, fitness for a particular purpose, and non-infringement are excluded.

14. Limitation of liability

To the extent permitted by law, Picuco will not be liable for indirect, incidental, special, or consequential damages, nor for loss of profits, data, reputation, or business arising from the use of the Site or Provider activities.

Nothing above limits liability that cannot be excluded by law (for example, for fraud or personal injury caused by negligence).

15. Indemnity

You will indemnify Picuco against third-party claims arising from your misuse of the Services, your content, or breach of these Terms.

16. Intellectual property

"Picuco" and associated distinctive signs are trademarks of the Company. Except with express authorization, their use is prohibited. The reputation derived from authorized use will benefit its owner.

18. Data protection and privacy

Picuco does not require registration nor collects mandatory data in the current model. The chat allows Users to share information voluntarily, which we may store for support, service improvement, and recommendations.

Please refer to the Privacy Policy to learn about: legal basis, purposes, retention periods, GDPR rights (access, rectification, deletion, opposition, limitation, portability), and contact details of the [DPO/Data Protection Officer if applicable].

19. Applicable law and jurisdiction

These Terms are governed by Spanish law. Except for mandatory consumer rules, any dispute will be submitted to the Courts and Tribunals of Madrid (Spain). If you are a consumer, you may claim in your residence in accordance with applicable regulations.

20. Miscellaneous

• Partial nullity: if any clause is null, the rest will remain in effect.
• No waiver: failure to exercise a right does not imply waiver.
• Assignment: you may not assign your rights without permission; Picuco may assign to group companies or successors.

Service Terms (supplementary provisions)

These provisions supplement the Terms of Use above.

A. Consent and updates

By using the Site, you accept these Terms. We may update them for legal, technical, or operational reasons. We will publish the update date. If you do not agree, you must cease use.

B. Duration; suspension and termination

We may suspend or interrupt the Services totally or partially for maintenance, security, or operational changes, attempting to minimize inconvenience. We may restrict access in case of non-compliance. You may stop using the Services at any time.

C. International use

Use of the Services must comply with applicable regulations in your country. Picuco operates in accordance with Spanish and EU regulations (LSSI, LGDCU, GDPR/LOPDGDD, DSA, when applicable).

D. Refunds and cancellations

Since Picuco does not charge nor manage payments in the current model, change and refund policies are the Provider's responsibility. Picuco may help channel communications, without assuming refund obligations or guarantees of the service provided by third parties.

E. Promotions and Pro subscriptions

The specific conditions of Picuco Pro Subscription and promotions will be defined in particular terms. We may modify or cancel them with reasonable prior notice when legally required.
