Digital Services Act (DSA)

In compliance with Regulation (EU) 2022/2065 of the European Parliament and of the Council of 19 October 2022 on a Single Market for Digital Services (Digital Services Act or DSA), Picuco Ventures SL provides users with the following information.
1. Nature of the service
Picuco (picuco.com) is an intermediary service of the information society within the meaning of Article 3 of the DSA Regulation. Specifically, Picuco operates as an online platform that allows activity and experience providers to offer their services to consumers.
Picuco does not organise or directly provide the activities. Picuco manages the booking and payment on behalf of the provider, acting as a commercial intermediary between customers and providers.
2. Single point of contact (Art. 11-12)
In accordance with Articles 11 and 12 of the DSA Regulation, Picuco's single point of contact for Member State authorities, the European Commission, the European Board for Digital Services, and users is:

3. Legal representative (Art. 13)
Picuco Ventures SL has its registered office in Madrid, Spain, within the European Union. Therefore, it is not required to designate a legal representative under Article 13 of the DSA Regulation, as this requirement applies only to intermediary service providers that are not established in the EU.
4. Notice of illegal content (Art. 16)
Any individual or entity may notify Picuco of the presence of content they consider illegal. Notices should be sent to:

The notice must include:
- A sufficiently substantiated explanation of the reasons why the information is considered illegal content.
- A clear indication of the exact electronic location of the information (for example, the URL of the page or activity listing).
- The name and email address of the individual or entity submitting the notice.
- A statement confirming the good-faith belief that the information and allegations contained in the notice are accurate and complete.
Picuco will acknowledge receipt of the notice without undue delay and will inform the notifier of its decision in a reasoned and timely manner.
5. Content moderation (Art. 14-15)
Picuco moderates content published on the platform, including activity listings created by providers and user reviews. Moderation is based on the following criteria:
- Compliance with applicable legislation.
- Accuracy of the information about the activities offered.
- Respect for the rights of third parties and the dignity of individuals.
- Absence of fraudulent, misleading, or harmful content.
At the current stage, all moderation is carried out manually. Picuco does not use automated content decision-making tools.
Moderation decisions are communicated to the affected provider or user together with a clear explanation.
6. Internal complaint mechanism (Art. 20)
If you are a provider or user and Picuco has taken any of the following decisions affecting you:
- Removal or restriction of the visibility of content you have published.
- Full or partial suspension or restriction of your account.
- Suspension of the service provided to you.

The complaint must identify the contested decision and set out the reasons why you believe the decision is incorrect. Picuco will review the complaint diligently, in a non-discriminatory and non-arbitrary manner, and communicate its reasoned decision without undue delay.
7. Out-of-court dispute resolution (Art. 21)
Without prejudice to your right to seek judicial remedies, you may refer to an out-of-court dispute settlement body certified in accordance with Article 21 of the DSA Regulation.

8. Transparency in the presentation of results
Picuco does not use recommender systems based on user profiling within the meaning of Article 27 of the DSA Regulation.
The order in which activities and experiences are displayed on the platform is determined by objective criteria such as search relevance, publication date, and availability. These criteria are not based on user profiling.
